Processing of (personal) data by the entity in charge of the online application process

1. General

This data protection declaration refers exclusively to the data collected as part of the online job application process and includes information on the processing of the candidate's personal data collected during this process.


The data provided by candidates through the portal will be processed by Innova Next S.L.U (hereinafter, Barrabés) as data controller and in accordance with current legislation on data protection, specifically with the European General Data Protection Regulation of April 2016 (GDPR) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

3. Processing of personal data in the job application process


Personal data is information about the personal or material circumstances of an identified or identifiable natural person, such as name, address, telephone number and date of birth, but also data about education, etc., which can be assigned to a specific person with reasonable effort. Information that does not serve to establish directly or indirectly the identity of an individual does not constitute personal data.


The personal data you provide are strictly necessary for the job application process, and you guarantee that they are true, accurate, complete and up to date, and you will be liable for any direct or indirect damage or loss that may arise as a result of your failure to comply with this obligation.


4. Legitimising basis and purpose of the processing of personal data in connection with the receipt of applications and the job application process


When submitting an application electronically, i.e. by e-mail or via our web form, the candidate's personal data is collected and processed for the purpose of managing and processing the selection process and implementing the appropriate pre-contractual measures.


The legitimate basis for us to process your personal data for the stated purposes is your freely given consent. By submitting an application via our recruitment page, you explicitly indicate your interest in working with us. The personal data you provide in this context will be used and retained exclusively for the purpose of job search and application.


In particular, we will collect the following data:

LinkedIn profile (optional)


● Channel through which you heard about us


In the course of the selection process, the candidate may also attach relevant documents, such as a cover letter, CV and qualifications, which may also contain personal data such as date of birth, address, etc.


Only authorised employees of the HR department or employees involved in the selection process have access to your data.


The storage of personal data is exclusively for the purpose of filling the vacancy for which the application has been submitted.


5. Retention periods

The candidate's personal data will be kept for the period necessary to fulfil the purpose for which they have been collected. Once the selection process has been completed and the vacancy has been filled, the data may be kept for the fulfilment of legal obligations or the defence of claims. Subsequently, if the legal basis for processing your data no longer exists, we will delete or anonymise your data. Thereafter, the data will only be available as metadata without direct personal reference for statistical purposes (e.g. percentage of women and men in applications received, number of applications per period, etc.).


In addition, we reserve the right to store candidate data for inclusion in our talent pool for a maximum of 2 years after the end of the selection process, subject to the express consent of the candidate to the retention of their data and for the sole purpose of identifying any other positions that may be of interest to them. This also applies, for example, to applications for training or internship positions. By accepting the privacy policy, the candidate expressly consents to the possible retention of his/her data for a longer period and their inclusion in our talent pool.


If in the course of the recruitment process the candidate receives a contract proposal and accepts it, the personal data collected during the recruitment process will be retained at least for the duration of the employment relationship.


6. Transfer of data to third parties


The data provided as part of the application is transmitted via TLS encryption and stored in a database. This database is operated by Personio GmbH, which distributes an applicant and human resources management software ( https://www.personio.es/legal-notice/ ). In this context, Personio is our processor in accordance with Article 28 of the GDPR. The basis for the processing is the execution of the data processing agreement (DPA) concluded between Barrabés, as data controller, and Personio.


7. Rights of the data subject


Insofar as we, as the responsible body, process personal data, the applicant, as a data subject, is entitled to certain rights under Chapter III of the GDPR, depending on the legal basis and the purposes of the processing for which the data is intended, namely the right of access (Article 15 of the GDPR), the right of rectification (Article 16 of the GDPR), the right of erasure (Article 17 of the GDPR), the right to restriction of processing (Article 18 of the GDPR), the right to data portability (Article 20 of the GDPR) and the right to object (Article 21 of the GDPR). Insofar as the processing of personal data is based on your consent, pursuant to Article 7(3) of the GDPR, you have the right to withdraw this consent at any time.


To exercise your rights as a data subject in relation to the processing of data during the online job application process, you must write to us, accompanied by your National Identity Card or equivalent document, to the e-mail address provided for this purpose, dataprotection@barrabes.biz indicating (in "Subject") the right you wish to exercise.


Likewise, you have the right to lodge a complaint with the competent Data Protection Supervisory Authority, especially when you have not obtained satisfaction in the exercise of your rights. The Spanish Data Protection Agency offers the possibility of processing the complaint through its website (www.aepd.es).


8. Final provisions


We reserve the right to amend this data protection statement at any time in order to comply with current legal requirements or to reflect changes made in the job application procedure or other similar processes. In such a case, if the candidate re-visits this recruitment page or applies, the new data protection declaration will apply to him/her.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website.
